Premium processing (I-129 only)

If you file Form I-129 for an E-2 change of status or extension, you can add Form I-907. USCIS must take action — approve, deny, or issue a Request for Evidence (RFE) or Notice of Intent to Deny (NOID) — within 15 business days, or refund the premium fee.[1,2]

The premium processing fee for E-2 has been $2,965 since March 1, 2026.[1,3,4]

An RFE or NOID stops the clock; a new 15-business-day period starts when USCIS receives your response. Business days exclude weekends, federal holidays and days federal offices are closed.[1]

Premium processing does not apply to visa applications at a consulate, and USCIS does not offer it for dependents' Form I-539 filed with an I-129 petition.[2]
