Specific evidence

Published material about you

Whether articles or coverage are about you and your work and appeared in qualifying media.

What USCIS is questioning

  • Whether the material is about you and your work in the field, and whether it appeared in a professional or major trade publication or other major media.[1,2]

The legal standard

  • 8 CFR 204.5(h)(3)(iii) covers published material about you in professional or major trade publications or other major media, relating to your work in the field for which classification is sought, and requires the title, date, author, and any necessary translation.[2]
  • The Policy Manual accepts material on a broader topic if it substantially discusses your work and mentions you, and coverage of a team if it names you or other evidence documents your significant role. The publication's audience and circulation matter. Since October 2024, the material does not have to show the value of your work.[1,3]

How the request usually reads

  • Interpretation An RFE on this criterion typically says the articles focus on your employer or a product, lack the title, date, or author, or appear in outlets not shown to be major media or professional publications, and asks for circulation or readership information.[1,4]

Evidence petitioners often provide

  • Interpretation Complete copies of the articles showing the title, date, and author; certified translations; circulation, readership, or audience data for each outlet; and, for team coverage, evidence of your role.[1,2,5]

Where responses go wrong

  • Marketing materials and paid content, including paid placements in major outlets, generally do not count as published material about you.[1]
  • Material that covers a broader topic counts only if it substantially discusses your work and connects you to it.[1]
