Specific evidence
Authorship of scholarly articles
Whether you have authored scholarly articles in qualifying publications, and what their caliber shows.
What USCIS is questioning
- Whether you authored scholarly articles in your field in professional or major trade publications or other major media, and, in the final merits review, what the caliber of those publications shows.[1,2]
The legal standard
- 8 CFR 204.5(h)(3)(vi) covers authorship of scholarly articles in the field in professional or major trade publications or other major media.[2]
- High confidence Peer-reviewed journal articles and published conference proceedings can qualify. Kazarian v. USCIS held that USCIS may not require evidence of the research community's reaction before counting the articles; citations belong in the final merits review.[1,3]
How the request usually reads
- Interpretation An RFE on this criterion typically questions whether the articles are scholarly or whether the outlet is a professional publication, or, at the final merits stage, whether the publication record shows top-of-field standing.[1,4]
Evidence petitioners often provide
- Interpretation Copies of articles showing your authorship; information about each journal or proceedings (peer review, audience); and, for final merits, journal rankings, citation comparisons, and your author position, each with an explanation.[1]
